Terms of Service

1. Introduction

Welcome to SkyClaim. These Terms of Service ("Terms") govern your use of our website and flight compensation claim services. By using our services, you agree to be bound by these Terms.

SkyClaim helps passengers claim compensation from airlines for delayed, cancelled, or overbooked flights under EU Regulation 261/2004 and other applicable passenger rights regulations.

2. Our Services

SkyClaim provides the following services:

  • Assessment of your eligibility for flight compensation
  • Preparation and submission of claims to airlines
  • Negotiation with airlines on your behalf
  • Legal action if necessary to secure your compensation
  • Processing and transfer of compensation payments to you

3. No Win, No Fee

Our services operate on a "no win, no fee" basis. This means:

  • You pay nothing upfront to submit a claim
  • If your claim is unsuccessful, you owe us nothing
  • If your claim is successful, we deduct our service fee from the compensation received

4. Service Fee

Our service fee is 15% (including VAT) of the compensation amount received. This fee is only charged upon successful resolution of your claim.

For example, if you receive €400 in compensation, our fee would be €60, and you would receive €340.

If legal proceedings are required and we engage external legal counsel, an additional fee of up to 10% may apply. You will be informed and asked for consent before any legal action is initiated.

5. Your Obligations

By using our services, you agree to:

  • Provide accurate and complete information about your flight and circumstances
  • Submit authentic documents (booking confirmation, boarding pass, ID)
  • Not pursue the same claim through other channels while we handle it
  • Inform us promptly of any direct communication from the airline regarding your claim
  • Respond to our requests for additional information in a timely manner
  • Not submit fraudulent or misleading claims

6. Authorization

By submitting a claim through SkyClaim, you authorize us to act on your behalf in all matters related to your compensation claim. This includes communicating with airlines, accessing your booking information, and if necessary, initiating legal proceedings. You assign the right to claim the compensation to SkyClaim for the duration of our engagement.

7. Claim Process

Our claim process typically follows these steps:

  1. You submit your flight details and we assess eligibility
  2. If eligible, you provide required documents and sign the authorization
  3. We submit the claim to the airline
  4. We negotiate with the airline and follow up as needed
  5. Upon successful resolution, we deduct our fee and transfer the remaining compensation to you

The duration of the claim process varies depending on the airline's responsiveness and whether legal action is required. Most cases are resolved within 2-4 months.

8. Payment

Once compensation is received from the airline, we will transfer your share (compensation minus our service fee) to the bank account you provided. Payments are typically processed within 14 business days of receiving funds from the airline.

You are responsible for ensuring your bank details are accurate. SkyClaim is not liable for delays or losses resulting from incorrect banking information.

9. Cancellation and Withdrawal

You may withdraw from our services at any time by notifying us in writing. However:

  • If you withdraw after we have already submitted your claim, and the claim subsequently succeeds (whether through our efforts or your own), our service fee remains due
  • If you accept a direct settlement from the airline while we are handling your claim, our service fee is payable on the amount received

10. Limitation of Liability

SkyClaim shall not be liable for:

  • Unsuccessful claims due to circumstances beyond our control
  • Delays caused by airlines, courts, or third parties
  • Losses arising from inaccurate information provided by you
  • Any indirect, incidental, or consequential damages

Our total liability shall not exceed the service fee amount for the relevant claim.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of SkyClaim and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction where SkyClaim is registered. These Terms are governed by and construed in accordance with EU law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms. For active claims, the Terms in effect at the time of claim submission will apply.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
